6 West 24th Street, application to legalize an illuminated sign

WHEREAS, Bo's Kitchen and Bar Room occupies a building located at 6 West 24th Street in the Ladies' Mile Historic District; and

WHEREAS, The applicant installed on the building an internally illuminated sign ("Sign") displaying the characters BO'S without the proper approval of LPC; and

WHEREAS, LPC code does not permit illuminated signs as-of-right, and

WHEREAS, The sign is deemed illegal because of its illumination; and

WHEREAS, The applicant is requesting that the Sign be legalized by LPC; and

WHEREAS, The Sign was installed on the Building in 2014 after the opening of Bo's Kitchen and Bar Room; and

WHEREAS, The applicant is believed to have been acting in good faith when installing the Sign without the approval of LPC; and

WHEREAS, There is photographic evidence that the Building had an illuminated sign before the District was established; and

WHEREAS, The Sign is illuminated with retro looking incandescent light bulbs, producing a soft glow, and is not backlit; and

WHEREAS, The Sign is appropriate in style and size for the building and is harmonious with the surrounding buildings in and bordering the District; and

WHEREAS, Given that historically the building had an illuminated sign, the Sign is deemed contextual and is not setting a precedent; and

WHEREAS, Given that the sign has a historic precedent, and does not use LED or backlighting, which continue to be unacceptable in the historic district; therefore be it

RESOLVED, Community Board Five recommends approval of the application to legalize an internally illuminated sign on the building at 6 West 24th Street.
