Application from Beerco Restaurant d/b/a Belgian Beer Café for a new small unenclosed sidewalk café at 220 Fifth Avenue
WHEREAS, Beerco Restaurant d/b/a Belgian Beer Café ("Applicant") has submitted an application seeking permission to install and operate a small seasonal unenclosed sidewalk café at 220 Fifth Avenue to consist of 6 tables and 12 chairs for seasonal seating, all located on Fifth Avenue; and
WHEREAS, The hours of operation of the proposed sidewalk café are from noon to 10pm on weekdays and 11am to 11pm on weekends; and
WHEREAS, The proposed sidewalk café has a minimum of 12 feet of sidewalk space for the entire length of the sidewalk, and the address is zoned for this type of seasonal café; and
WHEREAS, Applicant intends to apply for a liquor license for the sidewalk café and will return to Community Board Five for that purpose; and
WHEREAS, A current landmarks property violation on the premises is the result of the former owner of the building, and Applicant is in the midst of addressing that violation, with the understanding that Community Board Five will support this application only if the violation is resolved; therefore, be it
RESOLVED, Community Board Five recommends denial of the application from Beerco Restaurant d/b/a Belgian Beer Café for a new small unenclosed sidewalk café at 220 Fifth Avenue unless the current landmarks property violation on the premises is resolved.
