APPLICATION FOR A 10 YEAR EXTENSION OF TERMS OF THE VARIANCE WHICH PERMITS NON-RESIDENT PROFESSIONAL USE (USE GROUP 6) THROUGHOUT A BUILDING LOCATED AT 30 CENTRAL PARK SOUTH IN AN R-10 RESIDENTIAL DISTRICT.

WHEREAS, The Board of Managers of Central Park South Medical Condominium is applying to extend the terms of a BSA variance to allow non-conforming use at 30 Central Park South, pursuant to New York City Zoning Resolution 11-411; and

WHEREAS, The variance was first granted in 1955 under what was then section 7(e) of the Zoning Resolution; and

WHEREAS, The variance was extended four times, in 1974, 1984, 1994 and 2005; and

WHEREAS, The building is comprised of 15 stories, and is used by medical and dental offices; and

WHEREAS, Community Board Five has consistently approved the prior variance extensions of term; and

WHEREAS, Although two residents of the adjacent property, located at 24 Central Park South, attended a meeting the Land Use, Housing and Zoning Committee of CB5 and expressed complaints about vehicular parking violations emanating from 30 Central Park South, Community Board Five does not believe that denial of this renewal would be a responsible first step to address the parking violations; therefore be it

RESOLVED, Community Board Five recommends approval of the 10 year extension of term for a variance which permits non-resident professional use (Use Group 6) throughout a building located at 30 Central Park South in an R-10 residential district.
