839 Avenue of the Americas (at 30th Street), LT Hospitality management Inc, dba L’Amico, application for a new unenclosed sidewalk with 18 tables and 36 chairs

At the regularly scheduled monthly meeting of Community Board Five on Thursday, May 14, 2015, the Board passed the following resolution by a vote of 36 in favor; 0 opposed; 1 abstaining; 1 present but not entitled to vote.

WHEREAS, LT Hospitality management Inc, dba L'Amico (the Applicant) has submitted an application seeking permission to install and operate an unclosed sidewalk café on Avenue of the American's between 29th and 30th, outside the Eventi hotel; and

WHEREAS, The proposed unenclosed sidewalk café would have 18 tables and 36 chairs; and

WHEREAS, The proposed unenclosed sidewalk café would be installed 11.5 feet west the curb, and would allow a minimum of 8'-0" of unobstructed pedestrian sidewalk passage; and

WHEREAS, The Applicant will demarcate the space by using planters that will be placed within the approved sidewalk café space and will not infringe in the unobstructed pedestrian sidewalk passage; and

WHEREAS, The Applicant has agreed to revise the banners size to not exceed thirty inches as to comply with New York City regulations; and

WHEREAS, L'Amico will be open for business from 7:00 am until 10:00 pm daily and the applicant has agreed to not extend the café business hours; and

WHEREAS, The Applicant currently operates a privately owned public space on 30th Street that has failed to follow agreed and approved space guidelines, and significantly inhibited pedestrian flow in said area, but has made the commitment to appropriate and speedy action to rectify all issues; and

WHEREAS, The Applicant will offer the same menu as the indoor restaurant associated with the application but no liquor will be served until a liquor license is applied for and approved; therefore be it

RESOLVED, Community Board Five recommends denial of 839 Avenue of the Americas, LT Hospitality management, dba L'Amico, application for a new unenclosed sidewalk café unless the applicant complies with the requirements listed above.
