Application from Alexandra M. ValdesFauli on behalf of the Shake Shack for “Shake Shack Buyout,” a special event in Madison Square Park on Monday, June 29, 2015

WHEREAS, Alexandra M. ValdesFauli on behalf of the Shake Shack (the "Applicant") has submitted a permit application to hold "Shake Shack Buyout," a special private event in Madison Square Park; and

WHEREAS, Applicant submitted the application to the Parks Department only days before the Community Board Five Parks & Public Spaces Committee meeting and did not submit the Community Board Five Questionnaire and associated documentation; and

WHEREAS, The application cannot be heard at a public hearing before the date of the event, due to the timing of the application being submitted to the Parks Department, preventing the public from having any input as to this commercial use of public space; and

WHEREAS, Accordingly, the public has no information about this commercial event application; and

WHEREAS, Community Board Five takes its role in the review of applications for special events in our parks seriously and substantively reviews the applications in order to provide input to the Parks Department; and

WHEREAS, Because of the late notice by the Applicant, Community Board Five was unable to participate in this review process, Community Board Five and the public in general were denied the opportunity to learn about this event, ask questions, and provide input, resulting in an automatic denial pursuant to Community Board Five policy; therefore, be it

RESOLVED, Community Board Five recommends denial of the application from Alexandra M. ValdesFauli on behalf of the Shake Shack for "Shake Shack Buyout," a special event in Madison Square Park on Monday, June 29, 2015; and be it further

RESOLVED, Community Board Five continues to request that the Parks Department extend the minimum notice required of event applications, to ensure that they can be heard at a public hearing.
