50 West 22nd Street, Foyer LLC dba BXL Zoute, application for a new unenclosed sidewalk café with 4 tables and 4 seats.
At the regularly scheduled monthly meeting of Community Board Five on Thursday, March 14, 2013, the Board passed the following resolution by a vote of 34 in favor; 0 opposed; 1 abstaining.
WHEREAS, The applicant is seeking permission to operate an unenclosed sidewalk café with 4 tables and 4 chairs at 50 West 22nd Street between 5th Avenue and The Avenue of the Americas; and
WHEREAS, The proposed table and chairs would be positioned 24" beyond the property line; and
WHEREAS, The proposed table and chairs would be positioned between the stoops of the two adjacent buildings on the east and west, both of which extend approximately 42" out from the property line; and
WHEREAS, Since the table and chairs would be positioned inside the footprint of the two stoops, it would not interfere with the flow of pedestrian traffic; and
WHEREAS, There are sidewalk doors which are reinforced and are to remain locked while the sidewalk café is in use; and
WHEREAS, The proposed sidewalk café would not inhibit access into or out of the interior restaurant; and
WHEREAS, No comment or objection was raised by members of the public; therefore be it
RESOLVED. Community Board Five recommends approval of Foyer LLC's application to operate an unenclosed sidewalk café at 50 West 22nd Street.
