Newsstand Application #1472086, NEC 8th Avenue and West 54th Street

At the regularly scheduled monthly meeting of Community Board Five on Thursday, December 12, 2013, the Board passed the following resolution by a vote of 33 in favor; 0 opposed; 1 abstaining.

WHEREAS, The applicant is proposing a newsstand on the North East corner of West 54th Street and 8th Avenue; and

WHEREAS, The applicant was contacted by telephone on numerous occasions in order to discuss a number of concerns with the proposed location; and

WHEREAS, Although this application is compliant with DCA regulations, it is located in front of a building under construction; and

WHEREAS, The new building includes a banking institution on the ground floor in close proximity to the newsstand; and

WHEREAS, The NYPD has requested that newsstands not be placed near bank entrances due to security issues; and

WHEREAS, The bank entrance information is not yet known; and

WHEREAS, The proposed newsstand would have a negative impact on the visual ability of the NYPD to adequately monitor the bank premises, thus creating a potentially unsafe condition; and

WHEREAS, There are two existing newsstands in close proximity to the location of this application, including the NEC of West 53rd Street and 8th Avenue and the NWC of 53rd Street and 8th Avenue; therefore, be it

RESOLVED, Community Board Five recommends denial of the application to install a newsstand at the NEC of West 54th Street and 8th Avenue, and be it further

RESOLVED, Recognizing that the cost of applying for a newsstand is very high to small business owners and operators, Community Board Five requests that DCA refund the application fee for this application and all applications that are denied.
