  • An application for a Zoning Authorization by the City Planning Commission pursuant to Section 81-744(b) (Transfer of Development Rights from Listed Theaters) to transfer 48,180 square feet of unused development rights from the Majestic Theatre, 245 West 44th Street to a receiving site at 306 West 44th Street on the block bounded by West 44th Street, Eighth Avenue, West 43rd Street and Ninth Avenue.  The transfer of unused development rights would facilitate the development of a 34-story (including one mechanical floor) hotel building with ground floor retail containing 319,804 square feet of zoning floor area, and a seven-story affordable housing building with theater-related space on the ground and cellar levels containing 10,598 sf. of zoning floor area.
  • Application to the City Planning Commission (“Commission”) for approval of a Zoning Certification, pursuant to Section 81-744(a) of the Special Midtown District (Transfer of Development Right from Listed Theaters), to permit within the Theater Sub-District of the Special Midtown District the transfer of unused development rights from a Listed Theater (the “TDR Application”).  The approval by the Commission of the TDR Application will facilitate the transfer of up to 9,480 square feet of unused development rights from the Broadhurst Theatre (“BT”) located at 235 West 44th Street (Block 1016, Lot 11) to the property located at 120 West 41st Street (Block 993, Lot 43) in Manhattan (“Property”).
